The reality is that court proceedings can be massively lengthy and cause significant distress. So how can a separating/divorcing couple achieve a positive outcome in a quicker way? One highly effective way is the collaborative process.
In the collaborative process, each party has their own solicitor (who must have been trained as a collaborative lawyer by Resolution). The two parties and their two lawyers commit to resolving their issues in face to face discussions. The lawyers’ role is to advise and support their own clients and to work together to promote communication between the couple, achieving a solution which works for the whole family, and enables separated parents to co-parent.
Other experts such as financial advisers, pensions experts and family therapists can be brought in to the meetings to help the couple if necessary.
Collaborative law gives the couple greater control over how they manage their issues arising from the relationship breakdown, rather than the process being dictated by court deadlines and hearings. The collaborative process can be adapted to each family’s particular priorities and needs.
