On 23 March, the government published the first guidance about lockdown regulations. They confirmed that, where parents or someone with parental responsibility do not live in the same household, children under 18 can be moved between their parents’ homes to continue existing arrangements for spending time with each parent.
The President of the Family Division, Sir Andrew McFarlane, has provided additional advice, clarifying the best approach to putting in place safe arrangements for children during these unprecedented times.
‘The key message should be that, where Coronavirus restrictions cause the letter of a court order to be varied, the spirit of the order should nevertheless be delivered by making safe alternative arrangements for the child’.
